You might think that Republican Judge Jerry Smith - as a Federal Circuit Court judge - should be judicious in his public comments, so that he doesn't seem biased, one way or the other.
Sadly, with Fifth Circuit Judge Smith, you'd be wrong.
Instead, Judge Smith had a temper tantrum this week when President Obama made some comments to the press, on Monday, saying that the President was confident that the Supreme Court would hold up the Affordable Care Act. The President didn't question the authority of the Supreme Court - and he didn't attack the court, like some right-wing hacks have said. Here's what the President actually said:
Still, even in the face of those perfectly tame comments (that oddly echo similar comments by Mr. Obama's precedcessor), the Fifth Circuit Court Judge, demanded that Attorney Judge Eric Holder produce a three page, single-spaced letter, defending the President's comments.
While Holder had no legal responsibility to fulfill the judge's request, he did so anyway, explaining to Judge Smith that the President agreed that federal courts, including the Supreme Court, do have the full authority to edjuicate the constitutionality of the Affordable Care Act -- and any other law Congress passes.
